Can landlord turn off heat in mid-november for failure to pay rent?

My stepson has a signed lease with the landlord.Heat is included with rent. They have fallen behind on rent and landlord is threatening to turn off heat.There is also a baby in apartment.This is in NJ.Is he within his rights?
